District Agreement # ~2 -419 <br /> <br />RESOLUTION NO. 1999 -0 52. <br /> <br />A RESOLUTION OFTHE CITY COUNCIL OF THE CiTY OF SANTA <br />AUTHORIZING APPLICATION FOR FUNDS FOR THE <br />TRANSPORTATION ENHANCEMPZNT ACTIVITY PROGRA/Vl <br />UNDER TIlE 1998 TRANSPORTATION EQUITY ACT FOR /HE <br />21ST CEN'fTJRy FOR PROJECTS LISTED ON THE AIl'ACHED <br />PROJECT LIST. <br /> <br /> WHEREAS, the United Slate Congress in June 1998 enacted the Transportation <br />Efficiency Act of 1991 which make funds available to the Orange County Transportation <br />Authority (OCTA) for Iran~porta ion enhancement ac ~vities; and <br /> <br /> WHELLEAS~'OCTA has established the procedures and criteria for reviewing proposals; <br />and <br /> <br /> WHEREAS, Public Works Agency (PWA) o£ the City of Santa Ann possesses authority <br />to nominate transportation en. haneement activhies and to finance, acquire,.e-~d cormLrucl l!he <br />proposed projects; and .. <br /> <br />WHEREAS, formal action of the City Council or ~e City of Santa Ann .autherlzcs ihe <br />nomination o[' projects listed on the attached project list, including .all'understafi~.'.g ,and <br />assurances contained therein, and authorizes The Executive D~rector of t.he'..PW~.5'to, acttm <br />connection whh tho n=mination and to provide such additional informatlnn az ~tay b~ re~lUii'ed; <br />and ~ <br /> <br /> WHEREAS, the PWA will malntaln and operate the properly acquired, developed, <br />rehabilitated, or restored for the life of the resultant facility(ins) or activity; and <br /> <br /> WHEKEAS, with the approval of the California Department of Transportation (Cahrans) <br />and OCTA, the PWA or its successors in interest in the pro.hefty may transfer the responsiNh y <br />to maintain .'md operate the property; and <br /> <br /> WI-IEREAS, the PWA ,,viii give to Caltrans's and OCTA's representatives access to tad <br />the right to examine all records, book% papers or documents related to the transportation <br />enhancement activity; and <br /> <br /> WHEREAS, the PWA will cause work on the projects to be commenced within a <br />~'ea~onable time alter receipt ornotification from file State that funds have been approved by the <br />Federal Highxtmy Administration and that the project will be carried to completion with <br />reasonable diligence; and <br /> <br /> WHEREAS, the PWA ',viii comply, where applicable, with provisions of lite California <br />Environmental Quality Act, the National Environmental Policy Act, the American Disabilities <br />Act, the Secretm'y of Interior's Standards and Guidelines for Archeological and Historic <br />Presort'orion, and any other federal, state, and/or local laws, rules and/or regulations. <br /> <br />14 <br /> <br />(22) <br /> <br /> <br />
