ORDINANCE NO. NS-1327 - AN ORDINANCE OF THE <br />CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION <br />NO. 745 FILED BY TUSFORD-WARMINGTON REZONING <br />PROPERTY FROM THE R4 (SUBURBAN APARTMENT) DISTRICT <br />TO THE R4-PRD (PLANNED RESIDENTIAL DEVELOPMENT) <br />DISTRICT, AND AMENDING SECTIONAL DISTRICT MAP <br />8-5-9. <br /> <br />CA 10 <br /> <br />On the motion of Councilman Brandt, seconded by Councilman <br />Ward, and approved unanimously (4:0), the Planning Commission <br />Findings of Fact approving the following were received and filed: <br /> <br />VARIANCE 76-44 - Filed by Tusford-Warmington <br />Joint Venture to allow a single family detached <br />condominium project with less than the required <br />15-foot separation between Main buildings and <br />with less than the required 50% open space at <br />1401 North Williams in the R4 District. <br /> <br />CA 13 <br /> <br />CONDITIONAL USE PERMIT 76-21 - Filed by Tusford- <br />Warmington Joint Venture to permit a single <br />family residential condominium project and to <br />allow the sale of condominium units and lots <br />in conformance with the R4-PRD District (AA ?45) <br />at 1401 North Williams. <br /> <br />CA 13.1 <br /> <br />PUBLIC HEARING Mayor Garthe announced <br />APPEAL NO. 371 - VA 76-30 that this was the time <br />1010 W. 17TH STREET and place for the public <br />CONTINUED hearing of Appeal No. <br /> 371 of the approval <br />of Variance Application 76-30 to allow church parking along <br />the west property line at 1010 West Seventeenth Street in the <br />R1 and C1 Districts. <br /> <br />Charles Zimmerman, Planning Directory state~ that in 1951 <br />Variance No. 299 was approved and an arrangement agreed upon <br />between the church and the single family residents adjoining <br />the west property line of the church that there would be a <br />buffer area of trees and landscaping; that the church is now <br />proposing:198 parking spaces and removal of the buffer area; <br />and that the affected residents have appealed the approval <br />of the variance recommended by the Planning Commission on <br />September 27, 1976. <br /> <br />Speakers in favor of the Appeal were: <br /> <br />W. Lyle Boyle, 161S-North Freeman <br />Dennis Hayden, 1417 North Freeman <br />Hazel E. Welty, 1601 North Freeman <br />Bob Tompkins, 1611 North Freeman <br /> <br />They stated that in 1971 the Planning Commission determined that <br />there would be material damage to the residences if the buffer <br />area were not maintained; that the barrier protected the privacy <br />of the residents; that there is enough area for perking without <br />violating the buffer area; and that the church never installed <br />the hedges and landscaping that were required by the 1951 <br />variance, and the existing trees have not been properly cared for. <br /> <br />Those speaking in opposition to the Appeal were: <br /> <br />Fred Kearns, 15102 Flint Drive <br />Dr. Donald E.
