Planning Director Charles Zimmerman stated that a portion <br />of the 11.8 acres approved in Tract Map 9519 for 58 single <br />family residential lots, was zoned R2 and that a condition <br />of the approval of the Tract Map was that the-Applicant apply <br />for a zone change of the R2 portion; that in conformance with <br />that condition the subdivider has filed this Amendment Applica- <br />tion; and that the Planning Commission unanimously recommended <br />approval of the application following a public hearing held <br />on December 15, 1976. <br /> <br />There were no proponents or opponents; Mayor Garthe closed <br />the public hearing. <br /> <br />On the unanimously carried 6:0 motion of Councilman Ward, <br />seconded by Councilman Evans, the Negative Declaration was <br />approved and filed, and the following ordinance was placed <br />on first reading: <br /> <br />ORDINANCE NO. NS-1544 - AN ORDINANCE OF THE CITY <br />OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. <br />754 FILED BY GRACE ALBERTS REZONING PROPERTY FROM <br />THE R2 (MILTIPLB-FAMILY RESIDENCE) DISTRICT TO THE <br />R1 (SINGLE-FAMILY RESIDENCE) DISTRICT, AND AMENDING <br />SECTIONAL DISTRICT MAP 7-5-9. <br /> <br />CA 10 <br /> <br />PUBLIC HEARING - E.I.R. NO. 76-9 Mayor Garthe announced <br />AMENDMENT TO GENERAL PLAN that this was the time <br />CONTINUED and place for the public <br /> hearing of the Environ- <br />mental Impact Report and Amendment to the Land Use and Open <br />Space Elements of the General Plan to delete 20.4 acres on <br />the south side of Segerstrom Avenue, approximately 400 feet <br />east of Bristol from the Open Space Element and redesignate <br />as Low Density Residential. <br /> <br />Prior to any discussion of this matter, at 9:55 P.M., Council- <br />man Bricken excused himself from the meeting, stating that his <br />firm had participated in the preparation of the subject <br />Environmental Impact Report, and that this may constitute a <br />conflict of interest. <br /> <br />The Planning Director stated that the property was to be a <br />school site; that it had been declared surplus and was sub- <br />sequently purchased by the William Lyon Company for possible <br />RI single family housing development. <br /> <br />Proponent Mr. Gary Frye, representing the William Lyon Company, <br />5211 Highland Avenue, Yorba Linda, stated that the Company <br />proposed to build moderate priced housing on the property. He <br />assured Councilman Ward that the Lyon Company would follow all <br />the mitigating measures recommended in-the EIR. <br /> <br />Proponent Hugh Foreman, Civil Engineer on the project, agreed <br />that areas of potential incompatibility between adjacent <br />uses (apartments and commercial area) and the proposed single <br />family development would be mitigated and that single family <br />low density residential is the highest and best use for the <br />property. <br /> <br />Mr. Frye stated that potential buyers of the homes would be <br />given a disclaimer so that at the time of purchase they are <br />aware of possible problems. <br /> <br />There were no further proponents or opponents, and the Mayor <br />closed the public hearing. <br /> <br />CITY COUNCIL MINUTES 14 JANUARY 3, 1977 <br /> <br /> <br />
