<br />REL: 3/2/92 <br /> <br />. <br /> <br />RESOLUTION NO. 92-2 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVE- <br />LOPMENT AGENCY OF THE CITY OF SANTA ANA <br />APPROVING A THIRD AMENDMENT TO THE <br />PARTICIPATION AGREEMENT WITH SANTA ANA <br />VENTURE AND MAKING CERTAIN FINDINGS WITH <br />RESPECT THERETO <br /> <br />WHEREAS, this Redevelopment Agency and Santa Ana Venture <br />entered into an agreement, entitled "Fashion Square Commercial <br />Center site Participation Agreement," dated May 15, 1984, for the <br />redevelopment by Santa Ana Venture of a site located on the west <br />side of Main street, south of the Garden Grove Freeway; and <br /> <br />WHEREAS, the approval of the said agreement followed <br />certification by this Redevelopment Agency of an environmental <br />impact report, entitled "Fashion Square Commercial Center Final <br />Environmental Impact Report," prepared in accordance with the <br />requirements of the California Environmental Quality Act with <br />regard to the proposed redevelopment of the subject site in <br />accordance with the said agreement (the "Fashion Square EIR"); and <br /> <br />. <br /> <br />WHEREAS, the Department of Transportation of the State of <br />California ("CaITrans") is undertaking a project to widen the <br />Interstate 5 ("Santa Ana") Freeway, and as part of this project <br />intends to construct certain freeway ramps in the vicinity of the <br />Santa Ana Venture site; and <br /> <br />WHEREAS, CalTrans and the Federal Highway Administration have <br />prepared and certified a supplemental environmental impact <br />report/environmental impact statement in accordance with the <br />requirements of the California Environmental Quality Act which <br />addresses the environmental effects of the said freeway ramps, <br />which ramps are referenced therein as the "H-3 Alternative" (the <br />"CalTrans SEIR"); and <br /> <br />WHEREAS, this Redevelopment Agency and Santa Ana Venture do <br />now desire to amend their agreement to provide for the payment of <br />transportation improvement fees, to provide for the substitution of <br />the H-3 Alternative ramps for certain ramps specified in the <br />agreement, to provide for the funding of the H-3 Alternative ramps, <br />and to revise the freeway ramp development limit applicable to the <br />subject site; and <br /> <br />WHEREAS, the environmental staff of the city of Santa Ana <br />have, on behalf of this Redevelopment Agency, reviewed the Fashion <br />Square EIR and the CalTrans EIR and the proposed amendment to the <br />agreement to determine if any subsequent or supplemental <br />environmental impact report is required to be prepared prior to the <br /> <br />. <br /> <br />1 <br />
