Myrta L. Lucart, 3507 West Hazard Avenue, sumarized the protest contained in

<br />The Mayor asked anyone else wishing to speak in opposition or protest to the
<br />Assessment to address the Council.
<br />
<br />Paul Beavers, 910 North Bewley Street, said that he believed his assessment is
<br />unfair.
<br />
<br />The Director of Public Works explained the method and fornmla used to arrive at
<br />the assessment spread for Mrs. Lucart and Mr. Beavers.
<br />
<br />There were no other speakers, and the Mayor closed the public hearing.

<br /> action to deny initiation of revocation
<br />proceedings against Conditional Use Permit 78-3, filed by Property Resources, Inc.,
<br />to allow the conversion of an existing 304-unit apartment complex to condominiums
<br />at 1101 W. MacArthur in the R4 District, approved by Coumcil on April 17, 1978.
<br />
<br />Assistant City Attorney Edward Cooper explained that the City Council is con-
<br />strained in this matter because o£ the provisions of the Santa Aha Municipal Code
<br />Section 41-651, which basically states that the Planning Commission has juris-
<br />diction to conduct public hearings and revoke Conditional Use Permits; that the
<br />Code does not provide for any procedure whereby the Council can hear such revocation
<br />proceedings; that the only time the Council would become involved would be if the
<br />party's CUP were revoked, the party would have an appeal right to the City Council;
<br />that the Planning Commission conducted a public hearing with all interested parties
<br />present.
