ABSENT: Johnson and McGuigan <br /> <br />PUBLIC HEARING TO ADOPT RESOLUTION 85-18 DIRECTING CONDEMNATION OF <br />PROPERTY WITHIN THE A-2 DEVELOPMENT SITE (317 WEST FOURTH STREET) <br /> <br />The Real Estate Manager made a brief slide presentation showing the <br />site and the properties in question. He then pointed out to the <br />Agency that it was staff's opinion that the Public Hearing should <br />proceed in the event an escrow failed to close, pointing out that <br />it would not then be necessary to have another Public Hearing. <br /> <br />Chairman Griset advised those present that it was the time and <br />place for the Public Hearing on the issue of the public necessity <br />to acquire, by condemnation, properties identified by Assessor <br />Parcel Numbers, as Book 398, Page and Block 255, Parcels 22 and 23 <br />and Parcel 24, for redevelopment purposes. <br /> <br />. <br /> <br />He added that the Agency would first like staff to identify the <br />properties and the project and comment on the factors and evidence <br />necessitating the condemnation action. He requested that staff set <br />forth why the public interest and necessity require the project: <br />why the project is placed or located in the manner that will be <br />most compatible with greatest public good and the least private <br />injury; why the properties sought to be acquired are necessary for <br />the project; and, whether or not the offers as required by Section <br />7267.2 of the Government Code have been made to the owners of <br />record, or the offer has not been made because the owners cannot be <br />located with reasonable diligence. <br /> <br />2. <br />
