There being none he declared the public <br />hearing closed and stated he would now entertain a motion. It was <br />moved by Vice Chairperson McGuigan, seconded by Agency Member <br />Acosta and carried unanimously (7:0) that the Community <br />Redevelopment Agency: <br /> <br />1. <br /> <br />Adopt Resolution No. 86-58: A RESOLUTION OF THE COMMUNITY <br />REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA APPROVING AN <br />OWNER PARTICIPATION AGREEMENT BETWEEN THE AGENCY AND <br />SYCAMORE RETIREMENT APARTMENTS, LTD. AND MERCURY SAVINGS <br />AND LOAN ASSOCIATION. <br /> <br />2. <br /> <br />Approve the conceptual development <br />Sycamore Retirement Apartments, Ltd.; <br /> <br />plans <br /> <br />proposed <br /> <br />by <br /> <br />3. <br /> <br />Approve the project budget and authorize <br />implementation by the Redevelopment Commission. <br /> <br />its <br /> <br />It was moved by Vice Chairperson McGuigan, seconded by Agency <br />Member Acosta and carried unanimously (7:0) that the City Council <br />adopt: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />MAKING CERTAIN FINDINGS WITH RESPECT TO THE CONSIDERATION TO BE <br />RECEIVED BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA <br />ANA PURSUANT TO AN OWNER PARTICIPATION AGREEMENT BETWEEN THE <br />COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA AND <br />SYCAMORE RETIREMENT APARTMENTS, LTD. AND MERCURY SAVINGS AND LOAN <br />ASSOCIATION FOR THE SALE OF SAID REAL PROPERTY UPON THE TERMS AND <br />CONDITIONS CONTAINED IN THAT AGREEMENT. <br /> <br />PUBLIC HEARING TO ADOPT RESOLUTION 87-09 DIRECTING CONDEMNATION OF <br />LEASEHOLD INTEREST IN CERTAIN PROPERTY WITHIN THE FASHION SQUARE <br /> <br />~~~~~~~O~~:~SE~g~ Pi:~~L ~~~H6g~-2~~~~~' 2850 N. MAIN STREET, <br /> <br />Chairman Young stated that it was the time and place for the public <br />hearing on the issue of the public necessity to acquire by <br />condemnation leasehold interests in property identified as a <br />portion of Assessor Parcel Number, as Book 002, Page and Block 221, <br />Parcel 06, for redevelopment purposes. He then asked that staff <br />identify the property and the project and to comment on the factors <br />and evidence necessitating the condemnation action, and requested <br />that staff set forth why the public interest and necessity require <br />the project; why the project is planned or located in the manner <br />that will be most compatible with the greatest public good and the <br />least private injury; why the property sought to be acquired is <br />necessary for the project; and, whether or not the offer as <br />required by Section 7267.2 of the Government Code has been made to <br />the owners of record, or any offer has not been made because the <br />owners cannot be located with reasonable diligence. <br /> <br />-3- <br /> <br />~ <br />
