The Mayor closed the public <br />hearing. <br /> <br />The MOTION by Griset to approve and file Notice of Exemption and instruct <br />the City Attorney to prepare a resolution approving Minor Exception 80-29, <br />overruling the decision of the Zoning Administrator, died for lack of a <br />second. <br /> <br />MOTION was made by Yamamoto, seconded by Ward, to approve and file Notice <br />of Exemption and instruct the City Attorney to prepare a resolution <br />denying Minor Exception 80-29, affirming the decision of the Zoning <br />Administrator. <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Luxembourger, Markel, Serrato, Ward, Yamamoto <br />Griset <br />Bricken <br /> <br />CA 13.5 <br /> <br />ORAL COMMUNICATION Virgil Elkins, 2210 N. Poplar <br />CAPITAL IMPROVEMENTS BOND ISSUE Street, questioned the legality <br /> of Council's approval to place <br /> a $10,000,000 capital improve- <br />ments funding measure on the November 4 ballot by raising $1,000,000 <br />through a 10~ property tax increase, in light of Proposition 13 (Jarvis- <br />Gann Initiative). <br /> <br />Through the Council, the City Attorney responded that the funding will <br />be possible only if Proposition 4, which permits Cities to issue general <br />obligation bonds for certain specified purposes, passes concurrently. <br /> CA 68 <br /> <br />ORAL COMMUNICATION - GRISET Councilman Griset inquired as <br /> to whether the Council should <br /> be taking action to transmit <br /> City positions on state issues <br />to the California legislature since it is that body's last week in the <br />current session, and was informed by the City Manager that staff was <br />following through in this area. CA 57 <br /> <br />ORAL COMMUNICATION - WARD The Mayor informed Council of <br />"LOW RIDING" ACTIVITY current Police activity at <br />COUNCIL NOTIFICATION E1 Salvador Park on Sundays <br /> in efforts to curtail "low <br />riding" in the area, and stressed the importance of Council being <br />informed of such occurrences. CA 47 <br /> <br />ORAL COMMUNICATION - MARKEL In response to Councilman <br />CIVIC CENTER COMMISSION Markel's inquiry, the Mayor <br /> responded that the vacancy <br /> created by Tom McMichael's <br />resignation from the Civic Center Commission of Orange County was an <br />at-large appointment, and nominations by any Council member would be <br />welcomed.
