MOTION was made by Yamamoto, seconded by Serrato, to authorize the City <br />Attorney to file a civil suit against Clifford Williams, Sr., and Delores <br />Williams for damage to two police vehicles caused by their minor son <br />during a pursuit. <br /> <br />Motion passed on the following vote: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br /> <br />Griset, Luxembourger, Markel, Serrato, <br /> Ward, Yamamoto <br />None <br />Bricken <br /> <br />CA 139 <br /> <br />PUBLIC HEARING - APPEAL 422 <br />VA 80-15 - 1801E 4TH ST <br />CITY ATTORNEY INSTRUCTED <br /> <br />The Mayor reconvened the public <br />hearing on Appeal No. 422, VA <br />80-15. <br /> <br />There were no other speakers on the matter. The Mayor closed the public <br />hearing. <br /> <br />Following discussion, MOTION was made by Griset, seconded by Yamamoto, <br />to approve and file the Negative Declaration and to instruct the City <br />Attorney to prepare a resolution DENYING Appeal No. 422, confirming the <br />Planning Commission's approval of a 12-story building, but eliminating <br />condition 7.A.1)b) (allowing density for the building to remain at <br />530,000 sq. ft.); requiring a traffic signal at Cabrill.o Drive and Fruit <br />Street; and retaining the requirement for a 20 ft. setback area adjacent <br />to the parking structure, unless an acceptable alternative is agreed to <br />by the Planning Department. <br /> <br />Motion passed on the following vote: <br /> <br />AYE: <br />NOES: <br />ABSENT: <br /> <br />Griset, Luxembourger, Serrato, Ward, Yamamoto <br />Bricken, Markel <br />None <br /> <br />CA 13.3 <br /> <br />PUBLIC HEARING - C-5 SITE PLAN The Mayor announced that this was <br />REVIEW #43 - NW CORNER OF MAIN ST the time and place for the public <br />& DYER RD - CITY ATTORNEY INSTRUCTED hearing of C-5 Site Plan Review #43, <br /> northwest corner of Main Street and <br />Dyer Road, filed by United Orange County Neon Signs, Inc., requesting a pole <br />sign for the "Yellow Basket" restaurant. <br /> <br />The Planning Director presented the staff report and recommendations. <br /> <br />The Clerk of the Council reported there were no written communications. <br /> <br />There were no speakers on the matter.
