<br />, <br /> <br />- <br /> <br />. <br /> <br />,. . <br /> <br />- <br /> <br />, <br /> <br />RESOLUTION NO. 77-27 <br />PAGE TWO <br /> <br />WHEREAS, Agency also desires to delegate to Commission <br />authority to approve all contracts not exceeding $25,000 to be <br />funded through Agency's operation account no. 110-135, and if <br />such contracts exceed said amount, Agency desires Commission to <br />select the contractor for said project, which decision sha1~ be <br />reported to Agency at the latter's next available regular meeting, <br />and which selection of Commission shall be final thereafter unless, <br />by action taken by not less than a majority of the members of <br />Agency, such decision is amended, reversed, recinded, or other- <br />wise altered; and <br /> <br />WHEREAS, Agency desires to delegate authority to commis- <br />sion to implement projects within the Agency - approved capital <br />account or operation account budget, where total project expendi- <br />tures do not exceed the approved project budget by more than five <br />per cent (5%) but with Agency retaining the right to prior approval <br />of specific expenditures by Commission which exceed such project <br />budget by more than five per cent (5%); and <br /> <br />WHEREAS, as a result of Commission's expanded responsi- <br />bility, it is necessary to establish quarterly meetings, in addi- <br />tion t~ the regular monthly Agency meetings, so that Agency may <br />review Commission progress and discuss specific Agency concerns <br />over project implementation. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Community Redevel- <br />opment Agency of the City of Santa Ana: <br /> <br />1. Pursuant to California Health and Safety Code <br />Section 33202, Agency hereby delegates to Commission authority <br />to: <br /> <br />a) Adopt necessary procedures to implement prop- <br />erly all projects subsequent to budget approval and appropriation <br />of funds by Agency; and <br /> <br />b) Approve all contracts for projects to be <br />funded from Agency's capital account no. 110-136, with Agency <br />reserving no right of veto thereof; and <br /> <br />c) Select the consultant or contractor for all <br />contracts in excess of $25,000, which contracts shall be funded <br />by Agency's operation account no. 110-135. Each such decision of <br />Commission shall be reported to Agency at the latter's next avail- <br />able regular meeting, and shall be final thereafter unless, by <br />action taken by not less than a majority of the members of Agency, <br />such decision is amended, reversed, recinded, or otherwise altered; <br />and <br /> <br />d) Process all bid calls, bid awards, consultant <br />contracts, relocation payments, property acquisition contracts, <br />architectural review contracts and demolition contracts through <br />the normal finance and purchasing procedures of the City of Santa <br />Ana and in accordance with California Health and Safety Code <br />Section 33422. <br /> <br />2. Agency and Commission shall establish regular <br />quarterly meetings to review Commission's progress and to discuss <br />Agency concerns over project implementation. <br />
