The Mayor closed the public <br />hearing. <br /> <br />Following discussion, MOTION made by Griset, seconded by Yamamoto, to <br />approve and file the Negative Declaration, and to instruct the City <br />Attorney to prepare a resolution DENYING Application Appeal No. 430, <br />DENYING WA 80-5, and affirming the decision of the Planning Commission <br />passed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Griset, Luxembourger, Serrato, Ward, Yamamoto <br />None <br />Markel <br /> <br />CA 13.6(a) <br /> <br />PUBLIC HEARING - CUP NO. 80-21 The Mayor announced that this <br />800 E. DYER RD was the time and place for the <br />CA INSTRUCTED public hearing of Conditional <br /> Use Permit No. 80-21 to allow <br />retail sales of antiques and furniture at 800 East Dyer Road. <br /> <br />The Principal Planner presented the staff report and recommendations. <br /> <br />The Clerk of the Council reported there were no written communications. <br /> <br />Steve Shedd, President of Shedd-Silk, and John McMurray, McMurray-Sands <br />Architects, spoke in favor of the conditional use permit. <br /> <br />There were no other speakers on the matter. The Mayor closed the public <br />hearing. <br /> <br />Following discussion, MOTION made by Bricken, seconded by Serrato, to <br />receive and file the Negative Declaration, and to instruct the City Attorney <br />to prepare a resolution approving CUP 80-21, affirming the decision of the <br />Planning Commission, was passed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Griset, Luxembourger, Serrato, Ward, Yamamoto <br />None <br />Markel <br /> <br />CA 13.1 <br /> <br />STREET TREE MAINTENANCE PROGRAM <br />EXISTING LEVEL SERVICES <br />REAFFIRMED <br /> <br />the Transportation Director. <br /> <br />The Assistant City Manager <br />reviewed the alternatives <br />listed in the staff report <br />dated January 9, 1981, from <br /> <br />Following discussion, MOTION was made by Yamamoto, seconded by Luxembourger, <br />to approve the following: <br /> <br />Continuation of the existing level of street tree maintenance <br />with City forces ($400,000 annually) and contract services of <br />up to $250,000 (total $650,000 annually). <br /> <br />MOTION made by Griset to continue this matter died for lack of a second. <br /> <br />Original motion to approve recommendation passed on the following vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Luxembourger, Serrato, Ward, Yamamoto <br />Griset <br />Markel <br /> <br />CA 99 <br /> <br />CITY COUNCIL MINUTES 31 JANUARY 19, 1981 <br /> <br /> <br />
