MOTION was made by Luxembourger, seconded by Acosta, to receive and file <br />all communications reported by the Clerk of the Council. <br /> <br />Motion passed on the following vote: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br /> <br />Acosta, Bricken, Griset, Luxembourger, Markel, <br /> McGuigan, Serrato <br />None <br />None <br /> <br />The Mayor requested that persons who had filed a written protest come <br />forward to address the Council. <br /> <br />The following persons spoke in opposition to the Assessment District: <br /> <br />Zika Djokovich, 211N. Main St. <br />Sheldon Satnick, 784 San Lorenzo St., Santa Monica <br /> <br />The Council recessed at 9:50 p.m., and reconvened at lO:O1 p.m., with the <br />same members present. <br /> <br />Speakers in opposition continued to address the Council as follows: <br /> <br />Joe Gilmaker, 308 W. Birch St. <br /> <br />The following persons spoke, stating their qualified support of the <br />District: <br /> <br />Harry Gabriel, 901N. Bay Front, Balboa Island <br />Richard Beem, W. Fourth St. <br />Robert C. Theel, 31878 Camino Capistrano, Ste 278, San Juan Capistrano <br /> <br />Mr. Hal Butts informed the Council of estimated costs to the business <br />owners as a result of the Assessment District and the Seismic Ordinance. <br /> <br />The Council recessed at 10:44 p.m., and reconvened at 10:57 p.m., with the <br />same members present. <br /> <br />Speakers in favor of the District continued as follows: <br /> <br />Jack McCulloch, 222 W. Fourth St. <br />Barbara Mathewson, 202 N. Main St. <br /> <br />Following testimony from the audience, the Council asked a few more tech- <br />nical questions of staff and of Start Wolcott, representative of Rutan and <br />Tucker, the bond counsel firm. <br /> <br />The Mayor closed the public hearing. <br /> <br />Following comments by Councilmembers, the MOTION made by Serrato to continue <br />the matter for sixty days was withdrawn. <br /> <br />The Council recessed at 11:59 p.m., and reconvened at 12:13 a.m., with the <br />same members present. <br /> <br />Following further discussion, MOTION was made by Serrato, seconded by <br />Luxembourger, to continue consideration of the following for thirty <br />days: <br /> <br />1) <br /> <br />RESOLUTION NO. 81-140 - A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA FINDING AND DETERMINING <br />THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE <br />PROPOSED IMPROVEMENTS WITHOUT FURTHER COMPLIANCE WITH <br />THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND <br />MAJORITY PROTEST ACT OF 1931. <br /> <br />CITY COUNCIL MINUTES 271 AUGUST 27, 1981 <br /> <br /> <br />
