<br />. <br /> <br />. <br /> <br />. <br />. <br /> <br />. <br />. <br /> <br />".'O'.^""",._¡, <br /> <br />.;,"">""'".~,""'" <br /> <br />with the categories or classifications establ ished by the Agency for its <br />operating and capital outlay purposes; (iii) the assets and li'âbilities of the <br />Program at the end of such Fiscal Year, including a schedule of its Mortgage <br />Loans and the status of the Funds and Accounts established by this Resolution <br />and the Supplemental Resolution; and (iv) a schedule of its Bonds Outstanding <br />at the end of such Fiscal Year, together with a statement of the amounts paid, <br />redeemed and issued during such Fiscal Year. A copy of each such annual <br />report and the Accountant's Certificate shall be mailed by the Agency to the <br />Trustee and to each Bondholder who shall have filed his name and address with <br />the Agency for such purpose. <br /> <br />(C) The Agency shall maintain a record of the monthly payments to <br />be remitted to the Trustee by each Servicer and shall reconcile monthly the <br />scheduled amount with the amount actually remitted, all based on data to be <br />provided by the Servicers pursuant to Servicing Agreements, and shall provide <br />a copy of such record to the Trustee. <br /> <br />808. Personnel and Servicing of Mortgage Loans. The Agency shall at <br />all times appomt, retaln and employ competent supervisory personnel for the <br />purpose of carrying out the Residential Mortgage Financing Program and shall <br />establish and enforce reasonable rules, regulations and standards for the <br />construction and compl etion of all Res identia 1 Construction covered by said <br />Program and for servicing Mortgage Loans. All persons employed by the Agency <br />shall be qualified for their respective positions. Nothing herein shall mean <br />or be deemed to be a prohibition against the Agency's contracting for all or <br />any part of such services. <br /> <br />809. Premiums on Special Hazard Insurance. The Agency shall timely <br />deliver a Requisition to the Trustee for payment of the annual premiums on <br />Special Hazard Insurance and on Hazard Insurance, not otherwise paid, from <br />moneys in the Operating Fund, except that the first annual premium on Special <br />Hazard Insurance shall be paid from the Issuance Expense Account. In the <br />event that the company issuing the Special Hazard Insurance policy shall cease <br />to be licensed in the State, the Trustee is to exercise its best reasonable <br />efforts to obtain a comparable replacement policy with total coverage equal to <br />the then existing coverage of the Special Hazard Insurance policy. <br /> <br />810. Waiver of Laws. The Agency shall not at any time insist upon or <br />plead in any manner whatsoever, or claim or take the benefit or advantage of <br />any stay or extension of law now or at any time hereafter in force which may <br />affect the covenants and agreements contained in this Resolution or in any <br />Supplemental Resolution or in the Bonds, and all benefits or advantage of any <br />such law or laws is hereby expressly waived by the Agency. <br /> <br />811. Compl iance with Conditions Precedent. Upon the Issue Date of any <br />of the Bonds, all conditions, acts and things required by law or by the <br />'Resolution or Supplemental Resolution to exist, to have happened or to have <br />been performed precedent to or in the issuance of such Bonds shall exist, have <br />happened and have been performed, and such Bonds, together with all other <br />indebtedness of the Agency, shall be within every debt and other limit <br />prescribed by law. <br /> <br />46 <br />
