AYES: NOES: ABSENT: Acosta, Markel, Serrato Bricken, Griset, Luxembourger, McGuigan None MOTION was made by Griset, seconded by McGuigan, to approve and file the Negative Declaration and instruct the City Attorney to prepare a resolu- tion denying Appeal No. 453, approving the conditional approval of VA 81-20, however eliminating annual review requirements, and affirming the decision of the Planning Commission. PUBLIC HEARING - APPEAL NO. 456 The Mayor announced that this CUP 81-6 - 750 E. DYER ROAD was the time and place for the CA INSTRUCTED public hearing of Appeal Appli- cation No. 456, filed by Stewart Roth Antiques appealing the Planning Commission's denial of Conditional Use Permit No. 81-6 to allow retail sales of antique furniture at 750 E. Dyer Road in the M2 District. The Clerk of the Council reported there were no written communications. Stewart Roth, 810 N. French Street, spoke in favor of the appeal request- ing that it be approved with a termination date of December 30, 1982. There were no other speakers on the matter. The Mayor closed the public hearing. FIRST ST. was the time and place for the CONT'D TO 11/2/81 public hearing of Appeal Appli- cation No. 452, filed by Jose and Eulogio Bonnilla appealing the Zoning Administrator's denial of Minor Exception No. 81-20 to allow off-sale beer and wine (Type "20" License) in an existing market in a retail center at 1340 W. First Street in the C1 District. At the request of Rick A. Blake, attorney for the applicant, MOTION was made by Acosta, seconded by Luxembourger, to continue the public hearing to November 2, 1981.
