Motion passed on ,the following vote: AYES: Acosta, Bricken, Griset, Markel, McGuigan, Serrato NOES: None ABSENT: Luxembourger CA 13.5 PUBLIC HEARING- APPEAL #455 The Mayor opened the public EX 81-25 - 2317 W. FIRST ST. hearing on Appeal No. 455 CA INSTRUCTED filed by Cao Gia Phuoc appeal- ing the Zoning Administrator's denial of Minor Exception 81-25 to all ow on-sale beer and wine (Type "41" License) in an existing restaurant at 2317 W. First Street in the C2 District. The Chief of Planning presented the staff report and recommendations. The Clerk of the Council reported there were no written communications. Mr. Cao Gia Phuoc, 2317 W. First Street, spoke in favor of the appeal. There were no other speakers on the matter. The Mayor closed the public hearing. MOTION made by Griset to grant Appeal No. 455, approve EX 81-25, and over- rule the decision of the Zoning Administrator, died for lack of a second. MOTION was made by Acosta, seconded by McGuigan, to approve and file the Notice~of Exemption and instruct the City Attorney to prepare a resolu- tion denying Appeal No. 455, denying EX 81-25, and affirming the decision of the Planning Commission. Application No. 861 filed by River City Development Co., to rezone property at 4810 Westminster Avenue from the C2 (General Commercial), C5 (Arterial Commercial) and R1 (Single Family Residential) Districts to the R3 (Medium Density Multiple-Family Residential) District. The Chief of Planning presented the staff report and recommendations. The Clerk of the Council reported there were no written communications. There were no speakers on the matter. The Mayor closed the public hearing.
