The City Attorney recommended that the Council adopt the recommendation
as it stood, permitting the protest to go forward, and then he would
work out alternatives to lift the Police protest. He stated that if
conditions could be placed upon the license, it would insure that the
nature of the operation did not change.

The City Manager stated that the Police protest should be supported,
with the understanding that the protest would be withdrawn if the appli-
cant would agree to conditions in the license to insure perpetuation
of a first class eating establishment at that location.

Larry DeKrona, owner of the property, addressed Council, expressing his
support of the application and the proposed conditions.

MOTION was made by Luxembourger, seconded by Acosta, to receive and file
staff report on the following:

ALARCON, Juan & NEVAREZ, Daniel, 201-203 E. 4th Street -
Original Type "41" On-sale Beer and Wine, Public Eating
Place.
