Following discussion, MOTION was made by Bricken, seconded by Acosta, to instruct the City Attorney to approve and file the Negative Declaration, and prepare a resolution denying Appeal No. 465, denying VA 82-5, and affirming the decision of the Planning Commission. Motion passed on the following vote: AYES: NOES: ABSENT: Acosta, Bricken, Griset, Luxembourger, Markel, Serrato McGuigan None CA 13.3 APPEAL NO. 466 - VA 82-7 Following consideration of a 1322 W. 5TH STREET written communication from Dennis CONT'D TO 11/1/82 Lowry, Engineering Technology, Inc., requesting a continuance of Appeal No. 466, filed by Advanced Mobile Phone Service, appealing the Planning Commission's denial of Variance 82-7, to allow installation of a 154' antenna at 1322 West 5th Street which is not a permitted use in the C1 District, MOTION was made by Bricken, seconded by Luxembourger, to continue action on Appeal No. 466 to November 1, 1982. Motion passed on the following vote: AYES: NOES: ABSENT: Acosta, Bricken, Griset, Luxembourger, Markel, McGuigan, Serrato None None CA 13.3 APPEAL NO. 467 - VA 82-6 The Director of Planning and 2202 W. FIFTH STREET Development Services stated WITHDRAWN that he received a request from PLAN. C~M. DEC. AFFIRMED the applicant to withdraw Appeal No. 467, filed by California Towing, appealing the Planning Commission's conditional approval of Variance 82-6, to permit a towing operation, impound yard, and auto body shop at 2202 West Fifth Street in the M1 District. MOTION was made by McGuigan, seconded by Bricken, to accept the withdrawal of Appeal No. 467, pursuant to the conditions set forth in the staff report, dated September 3, 1982, and affirm the decision of the Planning Commission.
