PUBLIC HEARING - APPEAL NO. 470 The Mayor opened the public hear- <br />VA 82-10 - 1710 W. EDINGER lng regarding Appeal No. 470, <br />CA INSTRUCTED filed by David P. Stone, appeal- <br /> ing the conditional approval <br />of Variance 82-10, filed by the Salvation Army, to permit ballfield light- <br />ing as an accessory to the site, waiving the 35-foot height requirement and <br />the setback requirement at 1710 W. Edinger Avenue in the A1 District. <br /> <br />Councilmember Acosta declared a moral conflict of interest in this matter <br />and asked to be excused. MOTION was made by Luxembourger, seconded by <br />McGuigan, to excuse Councilmember Acosta from the proceedings regarding <br />Appeal No. 470, VA 82-10, due to a conflict of interest. <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Bricken, Griset, Luxembourger, Markel, McGuigan, Serrato <br />None <br />Acosta <br /> <br />The Director of Planning and Development Services and the Chief of Planning <br />gave the staff report and recommendations. <br /> <br />The Clerk of the Council reported no written communications. <br /> <br />The following persons spoke in favor of the appeal: <br /> <br />David P. Stone, 1709 W. Berkley <br />Paul W. Johnsonbaugh, 1614 S. Joane <br />Jackie Hawkins, 1801W. Berkley <br />Steve Gibbins, 1801W. Berkley <br />Stephanie Johnsonbaugh, 1614 S. Joane <br /> <br />Warren Inouye, attorney representing the Salvation Army, spoke against the <br />appeal. <br /> <br />There were no other speakers on the matter. The Mayor closed the public <br />hearing. <br /> <br />Major Joe Noland, Salvation Army, answered questions posed by Council. <br /> <br />Following discussion, MOTION was made by Serrato, seconded by Markel, to <br />approve and file the Negative Declaration and instruct the City Attorney <br />to prepare a resolution granting Appeal No. 470, granting Variance No. 82-10 <br />subject to the following conditions, and overruling the decision of the <br />Planning Commission: <br /> <br />1. That the lights be lowered to 35 feet in height; <br /> <br />2.
