<br />considered, the noise level will be higher at the ground level <br />of the building rather than at the roof of the building. Since <br />noise at the base of the building will be perceived as noisier, <br />the fact that this project is a high-rise building is irrelevant to <br />any airport noise impacts. <br /> <br />v. Therefore, there is no evidence of significant adverse noise <br />impacts as a result of this project and this project is in <br />conformance with the state airport noise standards. <br /> <br />3. The mitigation measures for this project will mitigate existing and <br />foreseeable airport noise problems. <br /> <br />I. The applicant's noise expert, Synectecology, and Mr. Vince <br />Mestre, JWA's contract acoustical consultant, agreed that it <br />would be perceived as noisier on the ground than it will be at <br />the roof of a 250' building at this location. <br /> <br />II. Synectecology states in the noise study prepared for <br />Geneva Commons development dated August 14, 2003, <br />"The project site is located approximately 1.5 miles <br />northwest of the John Wayne International Airport. The <br />project is located to the west of the established flight path <br />and is beyond the airport's 60-dBA CNEL noise contour. <br />Implementation of the proposed project would not expose <br />the new residents to excessive aircraft noise levels and no <br />mitigation measures are necessary." <br /> <br />iii. Additionally, any possible impacts will be mitigated by the <br />following mitigation measures that have been proposed and <br />agreed to by the applicant. <br /> <br />a) Prior to issuance of a certificate of occupancy, the <br />project proponent shall provide evidence to the City of <br />Santa Ana that a "Notice of Airport in the Vicinity" <br />(pursuant to Business and Professions Code ~11010) <br />has been recorded on the deed for each residential <br />unit and shall remain so recorded so long as the <br />airport is in operation. <br /> <br />b) The project, as a condition of the Conditional Use <br />Permit, will have interior noise attenuation to at least <br />42 dB (A) CNEL. <br /> <br />c) Prior to the issuance of any Certificates of Use and <br />Occupancy, field-testing in accordance with Title 25 <br />regulations shall be conducted to verify compliance <br /> <br />75C-288 <br /> <br />Resolution No. 2005- <br />Page 13 of 25 <br /> <br />
