<br />i. Prior to issuance of a certificate of occupancy, the project <br />proponent shall provide evidence to the City of Santa Ana <br />that a "Notice of Airport in the Vicinity" has been recorded on <br />the deed for each residential unit and shall remain so <br />recorded so long as the airport is in operation. <br /> <br />ii. The construction of the units will exceed the State- <br />recommended 45 dB (A) CNEL interior standard by being <br />conditioned under the Conditional Use Permit to have an <br />interior noise of 42 dB (A) CNEL. <br /> <br />E. How does this project minimize the public's exposure to excessive noise <br />and safety hazards within areas around public airports to the extent that <br />these areas are not already devoted to incompatible uses? <br /> <br />1 . The existing noise and safety hazards are not excessive, and the <br />actions taken by the City of Santa Ana "prevent the creation of new <br />noise and safety problems." <br /> <br />I. This area is already devoted to high-rise office towers. This <br />project does not create any new noise and safety problems. <br /> <br />a) Noise <br /> <br />(1) This project is outside the AELUP's 65 dB (A) <br />CNEL noise contour, identified as High Noise <br />Impact. <br /> <br />(2) Additionally, this project is outside the AELUP's <br />60 dB (A) CNEL noise contour, identified as <br />Moderate Noise Impact. <br /> <br />(3) Moreover, the above following mitigation <br />measures eliminate the creation of new noise <br />problems: <br /> <br />(i) The Notice of Airport in the Vicinity" will <br />be recorded on the deed for each <br />residential unit and shall remain so <br />recorded so long as the airport is in <br />operation. <br /> <br />(ii) The construction of the units will exceed <br />the State-recommended 45 dB (A) <br />CNEL interior standard by being <br />conditioned under the Conditional Use <br />Permit to have an interior noise of 42 dB <br />(A) CNEL. <br /> <br />75C-293 <br /> <br />Resolution No. 2005- <br />Page 18 of 25 <br /> <br />
