<br />negative or adverse impacts will be mitigated through <br />mitigation measures identified in Environmental <br />Impact Report No. 2004-02. <br /> <br />iii. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties <br />surrounding the area? <br /> <br />The proposed retail and services use will be situated <br />within the Cinema Tower site at 9 Hutton Centre. The <br />retail and service use component will provide a <br />service to the residents to the residents and office <br />employees, which will reinforce the economic viability <br />of the project and will assist in identifying the entire <br />Hutton Centre as a viable mixed-use community. <br /> <br />iv. Will the proposed use comply with the regulations and <br />conditions specified in Chapter 41 for such use? <br /> <br />The project will be in compliance with all applicable <br />provisions of Chapters 34 and 41 of the Santa Ana <br />Municipal Code as well as the provisions of the SO-76 <br />zoning district except for the parking, and tandem <br />parking. Two variances are required to deviate from <br />these standards. <br /> <br />v. Will the proposed use adversely affect the General Plan or <br />any specific plan of the City? <br /> <br />The proposed retail and service uses will not <br />adversely affect the General Plan as retail and service <br />uses are conditionally permitted uses within SO-76 <br />zoning designation. The General Plan Land Use <br />Element Policy 2.2 supports commercial lad uses in <br />adequate amounts to accommodate the City's needs <br />for goods and services. Further, Policy 4.3 of the Land <br />Use Element supports land uses that provide <br />community and regional economic and service <br />benefit. <br /> <br />G. Conditional Use Permit No. 2005-13 has been filed with the City of Santa <br />Ana seeking to allow the construction of the retail building located at 9 <br />East Hutton Centre Orive, which includes approximately 8,500 square feet <br />of space for two restaurants and will be located north of the Cinema Tower <br />along MacArthur Boulevard. <br /> <br />1.
