<br />. <br /> <br />. <br /> <br />. <br /> <br />2. <br /> <br />Santa Ana Municipal Code Section 41-638 authorizes the City <br />Council to grant a conditional use permit upon making certain <br />findings. <br /> <br />I. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community? <br /> <br />ii. <br /> <br />The proposed full service cafes and restaurants will <br />provide a service to the community by providing <br />additional dining opportunities in the area. This <br />amenity will provide a service and convenience to the <br />persons residing or working in the vicinity and <br />reinforce the economic viability of the entire project. <br /> <br />Will the proposed use under the circumstances of the <br />particular case be detrimental to the health, safety, or <br />general welfare of persons residing or working in the <br />vicinity? <br /> <br />The proposed full service cafes and restaurants at 9 <br />East Hutton Centre in conjunction with the rest of the <br />MacArthur Place South development will not be <br />detrimental to persons residing and working in the <br />area. The short-term and long-term unavoidable <br />adverse impacts identified in Environmental Impact <br />Report No. 2004-02 as it pertains to aesthetics, air <br />quality, and traffic and transportation, a statement of <br />Overriding Considerations could be issued by <br />decision makers to balance the economic, legal, <br />social, and technological and/or other benefits of this <br />project against the unavoidable environmental <br />impacts. Any other negative or adverse impacts will <br />be mitigated through mitigation measures identified in <br />Environmental Impact Report No. 2004-02. <br /> <br />iii. <br /> <br />Will the proposed use adversely affect the present economic <br />stability or future economic development of properties <br />surrounding the area? <br /> <br />The proposed full service cafes and restaurants will <br />generate City tax revenue and employment in the <br />community. The full service cafes and restaurants will <br />provide dining services that compliment surrounding <br />businesses and residents. As conditioned, the full <br />service cafes and restaurants will not adversely affect <br />economic development or stability of the area but will <br /> <br />Resolution No. 2005-064 <br />Page 9 of 28 <br />
