<br />Zoning Ordinance Amendment No. 2005-02 <br />Amendment to Conditional Use Permit No. 2003-37 <br />Conditional Use Permit No. 2005-19 <br />June 13, 2005 <br />Page 2 <br /> <br />Register of Historic Properties. Original Mike's occupies the first floor <br />of the building, with nine rental apartments located on the second floor. <br />A total of 157 parking stalls have been provided for the project. <br /> <br />The zoning designation for the site is Specific Development No. 72 (SD- <br />72), consistent with the General Plan land use designation of District <br />Center (DC). The site is surrounded by commercial uses to the north, east <br />and west, and commercial and residential to the south (Exhibits 1 and 2) . <br /> <br />Project Description <br /> <br />The applicant is proposing to modify the existing conditions of approval <br />as well as the SD-72 zoning designation for Original Mike's (Exhibits 3, 4 <br />and 5). Specifically, the applicant is proposing to serve alcoholic <br />beverages until 2:00 a.m., allow exterior special events on the premises, <br />allow a cover charge to enter the premises, allow amplified music within <br />the outdoor patio area and extend the hours of operation for the outdoor <br />patio to 9:00 a.m. through 6:00 p.m. Monday through Friday and 9:00 a.m. <br />to 10: 00 p. m. Saturday and Sunday, allow more than a three-piece band <br />within the outdoor area, and allow seven musicians with amplified <br />instruments within the interior of the premises. <br /> <br />Analysis of the Issues <br /> <br />On April 25, 2005 the Planning Commission held a hearing on the request by <br />several restaurants in the downtown and Artists Village areas to amend <br />their entitlements. The request by these restaurants to extend the hours <br />for the sale and service of alcoholic beverages and to allow entertainment <br />is a result of the growth in commercial and housing developments in the <br />downtown area. From this growth, a dynamic living community has emerged <br />within the downtown and Artists Village areas and has resulted in a <br />lifestyle that has been proven successful throughout downtowns in the <br />Uni ted States. However, due to concerns with the proposal to allow <br />unlimited exterior special events and a cover charge at Original Mike's, <br />the Planning Commission continued the item to further analyze the <br />request by the applicant. <br /> <br />Original Mike's was granted several entitlements in 2004, including a zone <br />change to the Specific Development No. 72 (SD-72) zoning designation and a <br />condi tional use permit to sell alcohol wi thin a restaurant (Exhibit 6). <br />The restaurant, which includes a bar, interior dining area and outdoor <br /> <br />75A-4 <br />
