<br />Zoning Ordinance Amendment No. 2005-02 <br />Amendment to Conditional Use Permit No. 2003-37 <br />Conditional Use Permit No. 2005-19 <br />June 13, 2005 <br />Page 4 <br /> <br />3. Allow a cover charge to enter the premises. <br /> <br />The applicant is seeking approval of a new conditional use permit <br />to have the ability to collect a cover charge for special <br />entertainment events that are offered in conjunction with the <br />normal restaurant operation. The applicant has verified that it is <br />not his intention to change the nature of the establishment from a <br />restaurant to a nightclub, but that these special events will <br />enhance the current restaurant operation. All activities <br />associated with the cover charge event will take place within the <br />confines of the restaurant building and, thus conditions regulating <br />the restaurant use adequately address any additional operational <br />issues posed by the addition of the cover charge events. It should <br />be noted that stand-alone nightclubs are not allowed under the <br />standards contained in SD-72. <br /> <br />4. Revise the conditions related to outdoor entertainment by allowing <br />amplified music with extended hours of operation from 9: 00 a. m. <br />through 6: 00 p. m., Monday through Thursday, and from 9: 00 a. m. to <br />10:00 p.m. on Friday, Saturday and Sunday, and allow more than the <br />currently permitted three-piece band. <br /> <br />The request to allow amplified music in the outdoor patio area, <br />extend the hours of operation in the outdoor patio and allow more <br />than a three piece band in the patio will allow the applicant to <br />offer entertainment that will complement the atmosphere of the <br />restaurant. To address prior concerns raised by the surrounding <br />neighborhood, amplified music in the patio area is proposed to be <br />restricted to no later than 6:00 p.m. Monday through Thursday and to <br />10:00 p.m. on Friday, Saturday and Sunday. Additionally, approval <br />of this request will be consistent with the policy direction of the <br />Planning Commission from the April 25th meeting. <br /> <br />5. Allow seven musicians with amplified instruments within the interior <br />of the premises. The current condition allows a maximum of five <br />musicians. <br /> <br />The size of the facility is easily able to accommodate a musical act <br />larger than five pieces currently allowed by the conditional use permit. <br />Since the number of musicians wi thin the restaurant does not generate <br /> <br />75A-6 <br />
