TIllS AMENDMENT, made and entered into this / t day of .JU kJ ' 2005, by and betWeen Curbside Inc., ("Consultant") and the City of Santa Ana, a charter city and municIpal corporation duly organized and existing under the Constitution and laws of the State of California ("City"), collectively referred to herein as "the Parties". A-2005-174 RE!:;IIA1~ A. The Parties entered into that certain agreement entitled "Agreement to Provide Household Hazardous Waste Collection" dated September 7, 2004, hereinafter referred to as "said Agreement", for providing collection and recycling of household hazardous waste; B. The Parties hereto now desire to amend the Term and Scope of Services provisions of said Agreement in order to in order to provide continuous uninterrupted service under the Agreement. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do hereby agree as follows: I. Section I, the "Scope of Services" of said Agreement is hereby amended to replace Exhibit A Scope of Work with Exhibit A "Revised Scope of Work" (attached hereto and incorporated herein by reference). 2. Section 3 of said Agreement, pertaining to "Term" of the Agreement is hereby amended to extend the termination date to June 30, 2007 in order to provide necessary continuous uninterrupted service to the Agency. The following language shall also be inserted into Section 3: The term of this Agreement may be extended upon a writing executed by the Executive Director of the Public Works Agency and the City Attorney. 3. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full force and effect.
