<br />REQUEST FOR <br />COUNCIL ACTION <br /> <br />~ <br />~taJ~ <br />~ <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />SEPTEMBER 6, 2005 <br /> <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2005-21 <br />AND MODIFICATION OF VARIANCE NO. <br />1995-09 TO ALLOW DRIVE THROUGH <br />WINDOW SERVICE AND A REDUCTION IN <br />PARKING AT 3770 WEST MCFADDEN <br />AVENUE - RIO VISTA WEST, LLC, <br /> <br />APPLIC~.! ~ ~ <br /> <br />~a~ <br /> <br />APPROVED <br /> <br />o As Recommended <br />o As Amended <br />o Ordinance on 151 Reading <br />o Ordinance on 2nd Reading <br />o Implementing Resolution <br />o Set Public Hearing For <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />CITY MANAGER <br /> <br />RECOMMENDED ACTION <br /> <br />Receive and file the staff report approving Conditional Use Permit No. <br />2005-21 as conditioned and modification to Variance No. 1995-09 as <br />conditioned. <br /> <br />PLANNING COMMISSION ACTION <br /> <br />On August 8, 2005, the Planning Commission approved and adopted the <br />Mitigated Negative Declaration and Mitigation Monitoring Program, <br />Environmental Review No. 2004-251, adopted a resolution approving <br />Conditional Use Permit No. 2005-21 as conditioned and adopted a <br />resolution approving the modification to Variance No. 1995-09 as <br />conditioned by a vote of 6:0 (Leo absent) to allow drive-through window <br />service and a reduction in parking in the North Harbor Specific Plan <br />(SP2) zoning district at 3770 West McFadden Avenue (Exhibit A). The <br />Planning Commission added a condition to replace all dead or <br />underdeveloped plants, trees, and groundcover within the existing <br />shopping center. Additionally, staff was directed to work with the <br />applicant in adding a landscape treatment to the southerly wall of the <br />site and to evaluate spillover lighting along the rear of the parking <br />lot, which could negatively impact residents to the south. <br /> <br />FISCAL IMPACT <br /> <br />There is no fiscal impact associated with this action. <br /> <br />/,-- <br /> <br /> <br />//'-1 <br /> <br />M.
