Approve and adopt the Mitigated Negative Declaration and Mitigation <br />Monitoring Program, Environmental Review No. 2004-251. <br /> <br />2. Adopt a resolution approving Conditional Use Permit No. 2005-21 as <br />conditioned. <br /> <br />3. Adopt a resolution approving the modification to Variance No. 1995- <br />09 as conditioned. <br /> <br />DISCUSSION <br /> <br />Request of Applicant <br /> <br />Rio Vista West, LLC is requesting approval of a conditional use permit to <br />allow drive-though window service and the modification of an existing <br />parking variance to allow the construction of two new restaurant pads at <br />3770 West McFadden Avenue. <br /> <br />Property Description <br /> <br />The property is an II-acre, rectangular shaped parcel located at the <br />southeast corner of Harbor Boulevard and McFadden Avenue. The site is <br />located within the North Harbor Specific Plan (SP-2) zoning district and <br />has a General Plan designation of General Commercial (GC).
