<br />This section shall conform to Section 2-3.1 of the Standard Specifications and these Special <br />Provisions. <br /> <br />The prime contractor agrees to pay each subcontractor under this prime contract for satisfactory <br />performance of its contract no later than 10 days from the receipt of each payment the prime <br />contractor receives from City of Santa Ana. Any delay or postponement of payment from the <br />above referenced time frame may occur only for good cause following written approval ofthe City <br />of Santa Ana. This clause applies to both DBE and non-DBE subcontractors. <br /> <br />The prime contractor agrees further to release retainage payments to each subcontractor within 30 <br />days after the subcontractor's work is satisfactorily completed. Any delay or ~ostponement of <br />payment from the above referenced time frame may occur only for good cause following written <br />approval of the City of Santa Ana. This clause applies to both DBE and non-DBE subcontractors. <br /> <br />2.04.19 Markup <br /> <br />This section shall conform to sub-section 3-3.2.3 of the Standard Specifications and these Special <br />Provisions. <br /> <br />Revise sub-section 3-3.2.3 (a) to read as follows: <br /> <br />(a) Work by Contractor. The following percentages shall be added to the Contractor's costs <br />and shall constitute the markup for all overhead and profits: <br /> <br />1) Labor 15 <br />2) Materials 15 <br />3) Equipment Rental 15 <br />4) Other Items and Expenditures 15 <br /> <br />To the sum of the costs and markups provided for in this subsection, 1 percent shall be <br />added as compensation for bonding. <br /> <br />(b) Work by Subcontractor. When all or any part of the extra work is performed by a <br />Subcontractor, the markup established in 2.04.19(a) shall be applied to the Snbcontractor's <br />actual cost of such work. A markup of 10 percent on the first $5,000 of the subcontracted <br />portion of the extra work and a markup of 5 percent on work added in excess of $5,000 of <br />the subcontracted portion of the extra work may be added by the Contractor. <br /> <br />17 <br />
