<br />13.0 <br /> <br />CONTRACTS <br /> <br />The County may from time to time enter into such agreements or contracts with <br />various vendors to purchase or lease equipment, and for installation, service and <br />maintenance of equipment as may be necessary and required in order to effectuate <br />this Agreement. All such agreements or contracts shall comply with applicable <br />State Law for counties. Appropriate shared costs will be included in backbone <br />cost-sharing allocations. <br /> <br />13.1 <br /> <br />County Responsibilities <br /> <br />OCSD/Communications shall negotiate and enter into agreements or contracts <br />with the various vendors as contemplated in this Agreement. <br /> <br />OCSD/Communications shall make payments due and payable under such <br />agreements On behalf of Partner and Participating Agencies. <br /> <br />OCSD/Communications shall negotiate and enter into agreements with new <br />Participating Agencies which may hereafter receive approval to access the System <br />for day-to-day operations pursuant to this Agreement, provided that: <br /> <br />. The Participating Agency agrees to the terms, conditions and costs for <br />entry as defined by the Governance Committee On behalf of the Partners. <br />Current policy by the Govemance Committee directs a system entry fee of <br />$3,29S per radio for Federal or State agency participation and $2,480 per <br />radio for agencies operating strictly within the confines of the County. <br />Participating Agencies are required to have their radios tempIated and <br />programmed by OCSD/Communications Division staff, participate in the <br />flat fee radio equipment maintenance program, and meet their annual <br />backbone cost sharing obligation. <br /> <br />. Requests by Participating Agencies will be evaluated in terms of potential <br />channel loading On the 800 MHz CCCS. This evaluation will include an <br />identification of the number of radios to be added, the type of <br />communication being conducted, and the specific radio cell that will be <br />impacted by the addition of this Participating Agency. If the addition of <br />the Participating Agency may cause an extensive impact on channel <br />loading, an outside channel loading analysis may be pursued at the <br />expense ofthe requesting Agency. <br /> <br />. Additional terms, conditions, and costs for entry shall be included in a <br />separate agreement as established by the Governance Committee. The <br />Governance Committee is given said authority under this Agreement with <br />the understanding that adequate fees will be charged as appropriate. Said <br />separate agreement shall include any direct or indirect compensation to <br />Partner Agencies for System Backbone usage by new Participating <br />Agency(s). <br /> <br />Joint Agreement Nov232004 Final <br /> <br />Page 10 <br />
