<br />1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 3. <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />III <br />26 <br /> <br />Agreement No. D03-046 <br /> <br />d) Review and approve plans and special provisions for the Project prior to award of <br />construction contract; <br />e) Review and approve any change orders for work in City jurisdiction prior to change <br />order authorization; <br />f) Designate a resident engineerlproject manager with signature authority to approve <br />change orders and inspect work within City jurisdiction; <br />g) Fund and pay for all Project costs within City jurisdiction (in excess of available grant <br />funds for the Project) and per "3. e)" below; <br />h) Review and approve Post Construction Best Management Practices in the Water <br />Quality Management Plan (WQMP) for the Project prior to award of construction <br />contract. <br />i) Review and approve final cost accounting upon Project completion, and <br />j) Concurrent with City execution of this Agreement, pass a resolution pursuant to <br />provisions of Section 1701 of the Streets and Highways Code, declaring that portion of <br />Project within City limits to be County highway during the period of construction. <br />Project Funding and Payments <br />a) County shall not invoice the City for any expenditure prior to completion of <br />construction of the Project. <br />b) City shall be solely responsible for any costs associated with the acquisition of right of <br />way from the Southern California Edison Company for the construction of the storm <br />drain. <br />c) City shall be solely responsible for any cost associated maintenance of Post <br />Construction Best Management Practices within City jurisdiction identified in the <br />WQMP. <br />d) City's share of the construction costs shall include a pro rata share of County's labor <br />and overhead charges for the work and the construction cost for the storm drain. <br />e) Any costs exceeding the amount of OCT A funds obtained by the City and the County <br />shall be shared one-third (1/3) by the City and two-thirds (2/3) by the County. <br />However, in no event, shall the City's share for construction of the improvements <br />exceed a maximum of $11 0,000. <br /> <br />3 <br />
