Both City and County ar~ expected ~o be the recipients of supplemental GMA funding <br />2 through the Orange County Transportation Authority ("OCT A"). <br /> <br />3 <br /> <br />AGREEMENT <br /> <br />4 <br /> <br />5 <br /> <br />7 <br /> <br />1. County shall: <br />a) Complete all necessary environmental documentation for the Project; <br />b) Perform and complete final design of the improvements; <br />c) Identify all necessary right-of-way for the entire Project; <br />d) Acquire all necessary right-of-way with the exception of that for City proposed storm <br />drain located within SCE property; <br />e) Obtain all required regulatory permits; <br />f) Advertise and award a construction contract subject to the availability of funds <br />appropriated for this purpose; <br />g) Administer the construction contract; <br />h) Fund and pay for all improvements within the unincorporated territory of the County of <br />Orange (in excess of available grant funds for the Project) and per "3. e)" below; <br />i) Prior to or concurrent with advertising to receive bids for Project construction, pass a <br />resolution, pursuant to provisions of Section 1700 of the Streets and Highway Code, <br />declaring that portion of the Project within City limits to be a County highway during <br />the period of construction; <br />j) Issue a notice of completion on the completed Project, and <br />k) Prepare a final cost accounting upon Project completion subject to the provisions of <br />Paragraph 3 below. <br />2. City shall: <br />a) Obtain all right-of-way necessary for City proposed storm drain improvements; <br />b) Provide County with a copy of City's resolution declaring the portion of Project within <br />the City to be a County highway for the purpose of construction of improvements and <br />also finding the Project to be consistent with the City's General Plan pursuant to <br />Section 65402 of the Government Code; <br />c) Issue a no fee encroachment permit for County and County's contractor to perform <br />Project construction within City area; <br /> <br />6 <br /> <br />8 <br /> <br />9 <br /> <br />10 <br /> <br />11 <br /> <br />12 <br /> <br />13 <br /> <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />23 <br /> <br />24 <br /> <br />25 <br /> <br />26 <br /> <br />2 <br />
