When an on-duty employee is <br />called to serve as a juror or non-party witness in any <br />court action, he or she shall be allowed to leave for the <br />time actually required for such service without loss of <br />pay. Each on-duty employee called for such service shall <br />present to the Fire Chief for examination the subpoena <br />calling him or her to such and shall pay into the City <br />treasury the fees collected for such service, with the <br />exception of reimbursement for transportation expenses, if <br />any. <br /> <br />Examination Leave. Employees participating in <br />examinations conducted during their normal working hours <br />for positions in the competitive service of the City of <br />Santa Ana will be granted leave with pay for the time <br />actually required, without loss of any accrued vacation or <br />compensatory time off benefits. <br /> <br />Unauthorized Absence. Unauthorized absence from duty for <br />any duration of time may be considered cause for <br />dismissal. Absence from duty without leave for five <br />consecuti ve working days shall be deemed a resignation <br />from service; provided, however, if upon return to duty <br />the person so absenting himself makes an explanation <br />satisfactory to the Fire Chief of the cause of his <br />absence, the Fire Chief may restore him to his position, <br />with the City Manager's written approval. <br /> <br />Authorized Absence Without Pay Short Term. Absence <br />without pay not to exceed five consecutive working days, <br />may be authorized in writing by the Fire Chief. Absence <br />without pay not to exceed 15 calendar days may be <br />authorized in writing by the Department with the written <br />approval of the Ci ty Manager. Such an absence may be <br />authorized only if in the judgment of the Fire Chief it <br />serves the best interest of the Fire Department. <br /> <br />Authorized Absence Without Pay - Long Term. Upon receipt <br />of a written request from an employee having permanent <br />status, plus action by the Fire Chief recommending <br />approval of the request, the City Manager may authorize a <br />leave of absence without pay for up to six months. <br /> <br />An employee returning to duty with the City shall inform <br />the Fire Chief and chief personnel officer of his or her <br />intention at least 30 calendar days prior to the <br />expiration of the six-month period (or shorter period if <br />the full six months is not taken).
