<br />notice, the Fire Chief will take steps necessary to <br />restore the employee to his or her former position. <br /> <br />In addition to the above, the City Manager may authorize a <br />further extension not to exceed a total of one year leave <br />of absence without pay. <br /> <br />An employee who plans to take a leave without pay must <br />gi ve a reasonable notice before the date he or she will <br />take the leave and the estimated duration of the leave. <br />Health and welfare insurance coverage will be continued <br />only if the employee pays a cash premium to continue <br />coverage while on a leave of absence without payor is <br />covered under the Family Medical Leave Act (FMLA) or <br />California Family Rights Act (CFRA) provisions. <br /> <br />12.9 <br /> <br />Industrial Leave. <br /> <br />A. Each "safety-member" employee covered by the <br />provisions of Labor Code Section 4850 who is compelled <br />to be absent from duty because of an illness or injury <br />covered by the State of California Workers' <br />Compensation Insurance and Safety Act shall, in lieu <br />of temporary disability compensation payable under the <br />aforementioned Act, continue to be paid his or her <br />normal salary and accrue other benefits in accordance <br />with the provisions of Labor Code Section 4850. <br /> <br />B. Any period of time during which an employee is <br />required to be absent from his or her position by <br />reason of an industrial injury or industrial illness <br />for which he or she is entitled to receive <br />compensation shall not be considered a break in <br />continuous service for the purpose of his or her right <br />to salary adjustments or to the accrual of vacation <br />and seniority. <br /> <br />12.10 Catastrophic Leave Donation. In order to assist employees <br />otherwise granted leave of absence without pay by the City <br />Manager because of a catastrophic non-industrial medical <br />condition or injury, the City and Association implement <br />the following Catastrophic Leave Donation Procedure. <br /> <br />Nothing herein shall be construed to alter City policies <br />and procedures as provided in the Charter or ordinances of <br />the City of Santa Ana or other provisions of this <br />Agreement with regard to granting unpaid leaves of <br />absence. <br /> <br />61 <br />
