The project proposes <br />a private use helistop on the top of the 32 -story building. It will be for <br />the exclusive and limited use of major tenants of the project. <br />Analysis of the facility in the EIR found that there is the potential for low <br />frequency noise impacts from helicopter traffic. Most impacts can be <br />mitigated by directing traffic to specific corridors, use of low noise <br />machines and limiting hours of operation and numbers of trips outlined in the <br />findings and conditions of approval. Conditions include: <br />1. The flight approach and departure for the helistop shall parallel <br />nearby freeways as permitted by air traffic control authorities; <br />2. Environmental mitigation measures, both design and operational, shall <br />be implemented by inclusion in project design or included in the CC &R's <br />and implemented by project management; <br />3. An operation and protocol manual shall be submitted for review and <br />approval prior to building permit for the building that the helistop is <br />located on. Mitigation measures shall be implemented as identified in <br />the mitigation monitoring program; <br />4. The number of flights to the thirty two story building helistop shall <br />not exceed eight flights (four operations) per day, one per hour, or <br />88 per month; <br />5. Flights shall not arrive or depart before 7 a.m. or after 7 p.m. on <br />weekdays and 9:00 a.m. and 5:00 p.m. on weekends. <br />6. Developer shall provide FAA approval prior to building permit; and <br />7. Use of the helistop shall be limited to "quiet" helicopters or similar <br />as identified in the EIR. <br />9. Development Agreement <br />The Development Agreement is a legal contract between the developer and the <br />City defining the terms and nature of development. The term of the agreement <br />is 20 years. It establishes development intensity, density, permitted uses <br />and standards for the term of the agreement. In exchange for the City <br />locking in standards and increasing allowable intensity, the development <br />agreement also requires certain community- oriented improvements.
