<br />3. EXHmITS. GENERAL PROVISIONS. <br /> <br />4.1 Property Subject to Agreement. Until released pursuant to the <br />provisions of Section 8.6 of this Agreement, the Property shall not be released from this <br />Agreement until Property Owner. <br /> <br />4.2 Effective Date; Duration of Agreement. The "Effective Date" of this <br />Agreement shall be the. date that the City Council ordinance adopting this Agreement becomes <br />effective, which date is thirty (30) days after the City Council meeting at which such ordinance is <br />adopted, unless this Agreement or Ordinance No. NS-_ is the subject of a referendum which <br />has received a prima facie sufficient number of signatures or unless its Effective Date is stayed <br />by order of a court with jurisdiction. The term of this Agreement shall be eight (8) years; <br />provided, however that the Owner may request one two-year extension from the Executive <br />Director, which request shall not be unreasonably denied; provided, however, that nothing herein <br />is intended nor shall it be in,terpreted to extend the period of validity of any approval issued in <br />conjunction with the City's Development Project Plan process or building permit, beyond local <br />requirement. <br /> <br />(b) Pursuant to Section 66452.6(a) of the California Subdivision Map Act, the <br />term of the Map, including any lot line adjustment or merger of lots (or any other tentative map <br />filed subsequent to the Effective Date of this Agreement), shall not expire during the term of this <br />Agreement. <br /> <br />(c) Notwithstanding subsections (a) or (b) hereof, if, at the end of the original <br />or any modified term, the Property is in the process of being developed, the term of this <br />Agreement shall be further extended until such in process construction is completed, not to <br />exceed an additional three years after expiration of the original or modified term. <br /> <br />(d) The expiration of this Agreement shall not terminate any land use <br />approvals approved concurrently with or subsequent to the approval of this Agreement, but shall <br /> <br />Ordinance NS-2700 <br />Page 8 of 41 <br /> <br />4 <br />
