A landscape <br />buffer will be provided along the wall adjacent to the secondary access <br />road to mitigate its visual impact to the community and the adjacent <br />properties. <br /> <br />Lastly, perimeter block walls are proposed for soil retention and <br />privacy. A six-foot high decorative block wall over a two-foot high <br />retaining wall will be constructed along the west and south property <br />lines to replace the existing perimeter walls. <br /> <br />Analysis of the Issues <br /> <br />Environmental Impact Report <br /> <br />The California Environmental Quality Act (CEQA) required the preparation <br />and approval of an environmental impact report (EIR) for this project. <br />The environmental issues analyzed in the EIR included aesthetics, air <br />quality, hazards and hazardous materials, and noise. In accordance with <br />CEQA, a draft EIR was circulated for review and comment to public, <br />local, regional and state agencies and interested parties on August 9, <br />2005 for a 45-day review period. On August 22, 2005 a public hearing <br />was held on the document in order to obtain input from interested <br />members of the public. By the close of the 45-day review period, a <br />total of five written comment letters on the document had been received. <br /> <br />The City has evaluated the comments received from persons or agencies <br />that reviewed the EIR. In accordance with CEQA, each public agency that <br />commented on the draft EIR will be provided with a response to its <br />comments at least 10 days prior to the EIR certification. The Responses <br />to Comments document, the Mitigation Monitoring Program and the Draft <br />EIR constitute the final EIR. In addition, the Findings of Fact and a <br />Statement of Overriding Considerations have been included for the <br />project (Exhibit 8) <br /> <br />The EIR concluded that, with the inclusion of mitigation measures, <br />potential impacts to aesthetics, air quality, hazards and hazardous <br />materials, and noise for the interior living areas, as well as cultural <br />resources, geology, water quality and hydrology can be reduced to a less <br />than significant level. The EIR also determined that implementation of <br />the project would result in an unavoidable adverse impact to the <br />exterior living areas, as noise generated from the Santa Ana Freeway <br />will exceed the City's exterior noise standard of 65 CNEL and cannot be <br />mitigated to a less than significant level with feasible mitigation <br /> <br />75C-6 <br />
