W~RK Ml\l VROpl:.ED <br />CLERK OF COUNCIL f<f, <br /> <br />DillE: t1~/;'-()?- MADISON MATERIALS AND CITY OF SANTA ANA <br /> <br />t, fJwt+ HOST FEE AGREEMENT <br /> <br />lr:wW <br /> <br />A-2005-243 <br /> <br />This AGREEMENT is made and entered into this 3d day of O'J-ol:J t' r' <br /> <br />,2005 <br /> <br />by and between MADISON MATERIALS, a California Corporation (hereinafter <br />"CONTRACTOR"), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California (hereinafter <br />"City"). <br /> <br />RECITALS <br /> <br />A. The Legislature of the State of California by enactment of California Integrated <br />Waste Management Act (CIWMA) of 1989 requires local agencies to make <br />provisions for solid waste handling and recycling within their jurisdictions. <br /> <br />B. The City of Santa Ana approved Conditional Use permit No. 00-13 to allow the <br />construction and operation of a heavy recycling and processing facility and <br />administrative offices in the City of Santa Ana commonly known as the Madison <br />Materials Facility. <br /> <br />C. The City Council of the City of Santa Ana desires the recycling and reuse of <br />construction and demolition debris and inert debris that may otherwise be disposed in <br />landfills. <br /> <br />D. City of Santa Ana would like to obtain the maximum diversion rate of C & D Debris <br />generated in the City of Santa Ana. <br /> <br />E. The City Council of the City of Santa Ana desires that small businesses be <br /> <br />encouraged and allowed to maintain a business presence in the City. <br /> <br />F. The City Council of the City of Santa Ana declares its intention of maintaining <br /> <br />reasonable rates for collection, transportation and recycling of C&D Debris. <br />
