<br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br /> <br />terms and conditions hereinafter set forth, the parties agree as follows: <br /> <br />1. DEFINITIONS <br /> <br />a. Construction and Demolition Debris (or C&D Debris) means any solid waste resulting <br />from temporary construction activities, including without limitation, construction, <br />remodeling, repair, demolition, site preparation and grading occurring at a Temporary <br />Site. C and D Debris does not include other waste materials generated at a site or <br />location that are not directly and primarily related to the construction activities. <br /> <br />b. Non-Exclusive Haulin!! A!!reement means an agreement between one of more entities <br />and the City for the collection and handling of C&D Debris and Incidental Wastes <br />produced and/or accumulated at Temporary Construction Sites in the City <br /> <br />c. Executive Director means the Executive Director of the Public Works Agency of the <br />City of Santa Ana. <br /> <br />d. Incidental Waste means solid waste generated at Temporary Construction Sites which is <br /> <br />incidental to construction activities occurring thereon, such as solid waste generated at a <br /> <br />construction office/trailer, food packaging and other wastes generated by construction <br /> <br />workers. <br /> <br />e. The Madison Materials Facilitv means CONTRACTOR's Large Volume <br />TransferlProcessing Facility located at 1035 E. 4th Street, Santa Ana, California. <br /> <br />f. Materials Recovery Facilitv or "MRF" means a facility permitted as a <br />TransferlProcessing Operation or Facility pursuant to California Code of Regulations, <br />Title 16, Section 17400, et. seq. <br /> <br />g. Non-Conformin!! Material means material which cannot be accepted for delivery under <br /> <br />any license, approval or permit issued to CONTRACTOR. <br /> <br />2 <br />
