'.~.J I () - !.:::O (p -c- 'Cliic, lW COIJNCII OPF f5').. -0 (p A-2004-053-0I ....~.-- 0.' rrns (j) (, --) f!11.~ THIS FOURTH AMENDMENT, made and entered into this 27th day of March, 2006, by and between ACCO Engineered Systems Inc, ("Consultant") and the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California ("City"), collectively referred to herein as "the Parties". FOURTH AMENDMENT TO AGREEMENT RECITALS: A. The Parties entered into Agreement #A-2004-053, dated April 5,2004, hereinafter referred to as "said Agreement", for the provision and repair of mechanical ventilation system services; B. The Parties now desire to renew said Agreement for an additional one-year term and to increase compensation to pay for services during the extended term. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do hereby agree as follows: 1. Section 2.a, COMPENSATION, is hereby amended to increase the compensation by adding $65,000.00 for maintenance and repair services during the extended term from May I, 2006 throgh April 30, 2007. 2. Section 3, TERM, is amended to extend the termination date for an additional one year term, thorugh April 30, 2007. 3. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full force and effect. II II II II II II II
