A-2007-041 Ie -I ~()7 \..;.),. ., !JI;Wjo7 FIFTH AMENDMENT TO AGREEMENT 0: FP.) lei:) (h..GAuff.-) . . th THIS FIFTH AMENDMENT, made and entered mto thls 20 day of February, 2007, by and between ACCO Engineered Systems Inc, ("Consultant") and the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California ("City"), collectively referred to herein as "the Parties". RECITALS: A. The Parties entered into Agreement #A-2004-053, dated April 5, 2004, hereinafter referred to as "said Agreement", for the preventive maintenance and repair of ventilation systems at various City facilities. B. The Parties hereto now desire to increase the Compensation to provide for services during the extended term, pay for additional projects and to extend the term of said Agreement. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do hereby agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be amended to authorize the repair of an evidence freezer, boiler inspections of an air conditioning system for the Fire Department's computer server room, and the installation of a radiant heater at the Corporate Yard, as set forth in invoices attached hereto as Exhibits A-2 through A-6, attached hereto and incorporated by reference. 2. Section 2.a, COMPENSATION, is hereby amended to increase the compensation by adding $38,000.00 for a total amount not to exceed $103,000.00 during the term from May 1, 2006 through June 30, 2007. 3. Section 3, TERM, shall be amended to extend the termination date from April 30, 2007 through June 30, 2007. II II II II II II II
