Proposals are due in the office .of the Executive Director, Public Works <br />Agency, at 20 Civic Center M-36, 4t" Floor, Santa Ana, ATTN: SOURI <br />AMIRANI, on or before Friday May 12, 2006 at 5:00 p.m. <br />V ISSUING OFFICE <br />Santa Ana Public Works Agency, Office of the Executive Director, 20 Civic <br />Center, 4t" Floor, Santa Ana, California 92702. <br />VI CONTRACT CONSIDERATION <br />Since total actual cost cannot be pre -determined, a fee for each assigned <br />project shall be negotiated. The Consultant shall be paid based upon hourly <br />rates, unit costs or fixed fee for services rendered. <br />VII PROPOSAL REJECTION <br />The City reserves the right to reject any or all proposals submitted, and is not <br />liable for any pre -contractual expenses: <br />Pre -contractual expenses are defined as expenses incurred by the offeror in: <br />(a) preparing the proposal in response to this RFP; (b) submitting that <br />proposal to the City; (c) negotiating with the City in any matter related to this <br />proposal; (d) any other expenses incurred by offeror prior to date of award, if <br />any, of the contract. Offeror shall not include any such expenses as part of <br />the price as proposed in response to this RFP. <br />VIII ADDENDA <br />Any subsequent changes in the RFP from the date of issuance to the date of <br />submittal will result in an addendum by the issuing office to those parties who <br />have provided the proper notice of interest in responding to the RFP. <br />IX PROPOSAL CONTENT AND SIGNATURE <br />Four (4) copies of the proposal will be required with all copies having been <br />signed by the individual or, if a company, the company official with the power <br />to bind the company in its proposal. To be considered, all proposals shall be <br />completely responsive to the RFP. <br />X ACCEPTANCE OF CONTRACT <br />The contents of the proposal of the successful consultants shall become a <br />contractual obligation if a contract ensues. Failure of a consultant to accept <br />this obligation will result in the cancellation of any award. Any damage <br />accruing to the City as a result of a failure to contract may be recovered from <br />the consultant. A sample agreement is attached in Exhibit B for reference. <br />12 <br />
