<br />ORDINANCE <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ADOPTING SPECIFIC DEVELOPMENT NO. 80 <br />(SD-80) AND REZONING THE PROPERTY LOCATED AT <br />320 WEST FOURTH STREET FROM CENTRAL BUSINESS <br />ARTIST'S VILLAGE (C3-A) TO SPECIFIC <br />DEVELOPMENT NO. 80 (SD-80) (AA NO. 2006-04) <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana does hereby find, determine <br />and declare as follows: <br /> <br />A. Applicant is requesting approval Mitigated Negative Declaration and <br />Mitigation Monitoring Program, Environmental Review No. 2004-234, <br />Amendment Application No. 2006-04 rezoning the property from Central <br />Business - Artist's Village (C3-A) to Specific Development No. 80 (SD-80), <br />Conditional Use Permit No. 2006-13 to allow a live-work community and <br />approval of Site Plan Review No. 2006-07 to allow the construction of a new <br />16,000 square foot mixed-use building with 1,189 square feet of retail on the <br />first floor, 3,544 of basement that includes parking and storage, as well as <br />five live-work community units occupying the remaining upper floors for the <br />property located at 320 West Fourth Street. <br /> <br />B. On September 25, 2006, the Planning Commission held a duly noticed <br />public hearing and unanimously voted to recommend that the City Council: <br /> <br />1. Approve and adopt the Mitigated Negative Declaration and Mitigation <br />Monitoring Program, Environmental Review No. 2004-234. <br /> <br />2. Adopt an ordinance approving Amendment Application No. 2006-04. <br /> <br />3. Adopt a resolution approving Site Plan Review No. 2006-07 as <br />conditioned. <br /> <br />4. Adopt a resolution approving Conditional Use Permit No. 2006-14 as <br />conditioned. <br /> <br />C. Mitigated Negative Declaration and Mitigation Monitoring Program, <br />Environmental Review No. 2004-234, Amendment Application No. 2006-04, <br />Conditional Use Permit No. 2006-13, and Site Plan Review No. 2006-07 <br />came before the City Council of the City of Santa Ana for a public hearing <br />October 16, 2006, and at that time considered all testimony, written and oral. <br /> <br />75C-72 <br />
