<br />ARTICLE I <br /> <br />1.0 RECOGNITION <br /> <br />1.1 Pursuant to the provisions of the Meyers-Milias-Brown Act, Government Code Section <br />3500, et seq., the City of Santa Ana (hereinafter called the "City") has recognized the <br />Santa Ana City Employees Chapter 1939/Service Employees International Union Local <br />347 (hereinafter called the "Union") as the recognized representative of the bargaining <br />unit which includes Part Time Civil Service personnel employed by the City of Santa <br />Ana in classifications listed in Exhibit "B". <br /> <br />1.2 During the term of this Agreement, no substantive issue ofrepresentation shall be raised <br />contrary to this recognition except as provided in Resolution No. 81-75, the Employer- <br />Employee Relations Resolution ofthe City of Santa Ana. <br /> <br />ARTICLE II <br /> <br />2.0 NON-DISCRIMINATION CLAUSE <br /> <br />2.1 The City and the Union agree that they shall not discriminate against any employee <br />because of race, color, sex, age, national origin or alienage, sexual orientation, political or <br />religious opinions or affiliations, or union membership, and that all jobs are open to <br />males and females. The City and the Union shall reopen any provision of this Agreement <br />for the purpose of complying with any order of a Federal or State agency or court of <br />competent jurisdiction requiring a modification or change in any provision or provisions <br />of this Agreement in compliance with State or Federal anti-discrimination laws. <br /> <br />2.2 Whenever reference is made to the masculine gender, it shall be understood to include the <br />feminine gender, unless expressly stated otherwise. <br /> <br />ARTICLE III <br /> <br />3.0 ATTENDANCE, HOUR LIMITS, AND NUMBER OF EMPLOYEES <br /> <br />3.1 Attendance. Employees covered by this Agreement shall be in attendance at their work <br />during hours prescribed by the Department Head or his/her designee(s) and shall not <br />absent themselves without approval of the Department Head or his/her designee(s). <br /> <br />3.2 Hour Limits. Persons appointed to a Part Time Civil Service position work an average of <br />20 - 30 hours per week and may not exceed 138 hours in any two (2) consecutive pay <br />periods, if working more than 30 hours per week in some of the weeks. <br /> <br />NOTE: Pay periods for Part Time Civil Service employees run from the II th of the <br />month, through the 25th of the same month, and from the 26th of the month through the <br />10th of the following month. The total number of hours worked depends on the number <br />of work days contained in two (2) consecutive pay periods. For example, in two (2) <br />consecutive pay periods which contain a total of 23 work days, a person appointed to a <br />Part Time Civil Service position may work a total of 92 to 138 hours. <br /> <br />3 <br />
