(E). All access of the Service will be deemed to be uses authorized by the <br />CUSTOMER and will so bind the CUSTOMER. <br />(F). CUSTOMER assumes the entire risk for the fraudulent and or unauthorized use <br />of all UserID codes and Passcodes. <br />(G). It is important for CUSTOMER to develop internal procedures to limit such <br />risk, which procedures will include, at minimum, (1) notifying MMC <br />immediately when a new person becomes a CUSTOMER User or when any <br />existing CUSTOMER User no longer is a CUSTOMER User, and (2) not <br />keeping, in any form or in any place, lists of ID codes or passwords. <br />(H). CUSTOMER agrees to notify MMC immediately when it becomes aware of <br />any loss or theft of, or any unauthorized use of, any USERID codes or <br />passwords, or any unauthorized entry into PropertyLINKTM <br />(I). In accessing the Services CUSTOMER will be receiving data through the <br />Internet. CUSTOMER acknowledges that when the Internet, or any other <br />electronic communications facilities are used to transmit or receive data, the <br />data may be accessed by unauthorized third parties. To reduce the likelihood of <br />such third party access, CUSTOMER agrees to transmit and receive data <br />through PropertyLINKTM using only software including, but not limited to, <br />Microsoft Internet Explorer 6.0 (or higher) browser software, the VPN Client <br />Software and the SecurelD. Additionally, CUSTOMER agrees to follow the <br />MMC log on procedures that support such protocols. <br />4.2 Third -Party Software. By signing below, CUSTOMER acknowledges they are <br />subject to all copyright, license and confidentiality provisions governing the third party <br />software that will be used in accessing the Services. <br />4.3 Scheduled Maintenance. The PropertyLINKTM system shall be unavailable from 1:30 <br />am to 3:00 am, PST on Sundays for regularly scheduled maintenance activities, other <br />special security and maintenance activity maybe periodical required. MMC will post <br />on the CUSTOMER service all special security and maintenance activities <br />requirements. <br />4.4 System Requirements. CUSTOMER must meet the following minimum system <br />requirements for MMC to provide the Services to CUSTOMER. <br />• IBM/PC Compatible 333mhz or higher <br />• RAM: 256 MB or higher recommended <br />• 20 G hard -drive with at least 20MB of free space <br />• Microsoft Windows 2000 (service pack 3 and above) or XP Operating System <br />(service pack 2) <br />• Microsoft TCP /IP installed (Confirm via Start > Settings > Control Panel > <br />Network > Protocols or Configuration.) <br />• Internet Explorer 6.0 or higher (Note: The speed of response time for the proposed <br />applications is not under the control of MMC and is limited by the Internet <br />availability and connectivity source used by the CUSTOMER) <br />MMC Services Agreement <br />Page 14 <br />
