<br />ARTICLE III <br />3.0 IMPLEMENTATION <br />3.1 This Memorandum of Understanding constitutes a recommendation jointly <br />submitted to the City Council of the City of Santa Ana. The parties agree that this <br />Memorandum of Understanding shall not be binding upon the parties until said City <br />Council: <br />A. Acts, by majority vote, formally to approve said Memorandum of <br />Understanding and, <br />B. Acts to appropriate the necessary funds required to implementthe provisions <br />of this Memorandum of Understanding that require funding. <br />3.2 Notwithstanding the foregoing, in the event the City Council fails to take all actions <br />necessary to implement this Memorandum of Understanding timely, the parties <br />understand that they may mutually agree to implement appropriate provisions ofthis <br />Memorandum that do not require specific approval by the City Council. <br />3.3 Implementation shall be effective as of the date approved by the City Council. Ifthe <br />parties fail to agree to implement provisions of this Memorandum not requiring City <br />Council approval, then negotiations shall resume upon the request of either party. <br /> <br />-6- <br />
