The detached garage at the rear of the <br />property is 427 square feet in size and matches the architectural features <br />of the house. <br /> <br />Analysis of the Issues <br /> <br />The applicant is requesting approval of a zone change to allow a single <br />family home. The subj ect site is located just west of the intersection <br />of Flower and Third Streets. The land uses found along Third Street in <br />the surrounding area consist of residential uses, government offices, <br />and Angels Park. <br /> <br />The pattern of residential uses on the block includes a mixture of <br />single- family, two- family and multi - family residences. The zoning for <br />the entire block is Professional (Pl, which allows office development. <br />Section 41-680 of the Santa Ana Municipal Code (SAMC) allows existing <br />residential uses in the P zone to remain since they are legal <br />nonconforming uses. Additionally, Section 41-681.4 (SAMC) allows <br />existing single-family and two-family residences located in a <br />Professional (P) zoning district to add additional square footage to the <br />structure; however, no new residential units can be added. <br /> <br />The project site is located within the area in the City that permits <br />bail bond businesses. Bail bond uses are permitted in the Professional <br />(Pl zone with an approved conditional use permit and must be within <br />2,000 feet of a jail facility. Additionally, a bail bonds use must be a <br />minimum of 150 feet away from any property with a residential zoning <br />designation. As proposed, the zone change to R1 will limit the area in <br />which bail bonds may be located. Based on the City's data for existing <br />bail bonds, the zone change will make one existing bail bond business <br />nonconforming and would remove 17 properties as potential bail bond <br />locations. <br /> <br />Existing bail bonds without an approved conditional use permit are non- <br />conforming and may continue to operate as long as the building does not <br />go vacant for 12 consecutive months. After 12 months of vacancy, the <br />bail bonds use would need to comply with all provisions of the City's <br />zoning code. A conditional use permit would be required and all current <br />development standards such as parking, landscaping, and building <br />setbacks would need to be met. <br /> <br />75A-3 <br />
