Trench Warranty Fee <br />Utility company required to repair <br />any defects in its restoration of <br />the pavement over a trench <br /> <br /> Trench Cut Fee <br />Provides incentive for utility company <br />to coordinate excavations with the <br />City's paving schedule <br /> <br />Insures that trenches are <br />maintained <br /> <br />Compensates for long-term damage <br />beyond the area of excavation <br /> <br />Requires submittal of five-year utility <br />master plans <br /> <br />Judy Woolen, representing The Gas Company, requested Councilmembers <br />carefully examine a sample ordinance developed by the utility companies and <br />similar to ones adopted by the cities of Oxnard, Bakersfield, Redlands and Los <br />Angeles. Trench cut fees, similar to the one the City of Santa Ana is <br />proposing, which were enacted by Union City and San Francisco are currently <br />being challenged in court. <br /> <br />When questioned, Chief Assistant City Attorney Kaufman stated that under <br />State law there could be no exemption from the proposed trench cut fee <br /> <br />Councilmember Moreno raised the issue of penalizing shoddy repair work but <br />Kaufman pointed out that the work is not shoddy, that trench cuts are inherent <br />defects which limit effective pavement life and that all trenches are "bad." <br /> <br />Councilmember Bist requested staff provide the Council with a comparison of <br />the two proposals - the City's proposed Trench Cut Fee Ordinance and the <br />Industry proposed "Model" Ordinance. <br /> <br />Water Resources Manager Thom Coughran - Water Rate Adjustment <br /> <br />Coughran provided a Water Rate Adjustment noting that the last increase was <br />in FY 96-97. He said the proposed 2.5% increase is based on the Consumer <br />Price Index and would close the shortfall between revenues and expenditures. <br />Coughran shared a 1998 water rate survey prepared by the Municipal Water <br />District of Orange County which showed Santa Ana ranked 26 out of 31 Orange <br />County cities. A typical monthly bill would increase from $23.56 to $24.28. <br /> <br />Engineering Services Manager George Alvarez - Use of Concrete for Street <br />Reconstruction <br /> <br />Alvarez touched briefly on the following in comparing use of asphalt concrete <br />(AC) with Portland Cement Concrete (PCC) for street reconstruction: <br /> <br />CITY COUNCIL MINUTES 158 JUNE 2, 1999 <br /> <br /> <br />
