<br />1/29/07LES <br /> <br />RESOLUTION <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF SANTA ANA <br />CONSENTING TO THE PAYMENT OF THE COST OF <br />IMPROVEMENTS TO A PUBLICLY OWNED IMPROVEMENT, <br />THE ELEVATOR AT THE TRAIN DEPOT, BY THE COMMUNITY <br />REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA, <br />PURSUANT TO SECTION 33445 OF THE HEALTH & SAFETY <br />CODE <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS <br />FOLLOWS: <br /> <br />Section 1: The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br /> <br />A. The Community Redevelopment Agency of the City of Santa Ana <br />(hereinafter referred to as the "Agency") is engaged in activities necessary <br />to execute and implement the Redevelopment Plan for the Merged Project <br />Area (the Redevelopment Plan"), in the area formerly known as the Inter <br />City Project Area. <br /> <br />B. Section 33445 of the Health & Safety Code, part of the California <br />Redevelopment Law, provides that the Agency may pay for all or part of the <br />cost of installation and construction of any building, facility, structure or <br />other improvement which is publicly owned either within or without the <br />project area, upon the consent of the City Council of the City of Santa Ana <br />("City"), if the following findings can be made: <br /> <br />1. That the public improvement is of benefit to the project area <br />or the immediate neighborhood in which the project is located; <br /> <br />2. That no other reasonable means of financing the public <br />improvement is available to the community; and <br /> <br />3. That the payment of funds for the cost of the public <br />improvement will assist in the elimination of one or more blighting <br />conditions inside the project area. <br /> <br />C. The City is the owner of The Depot at Santa Ana, a regional <br />transportation hub combining Amtrak, MetroLink, Orange County Transit <br />Authority and other bus services, along with office space for various State, <br />County and City departments. The Depot is located within the former Inter <br />City Project Area. Patronage at The Depot has escalated in recent years to <br /> <br />80C-5 <br /> <br />
