<br />over one million persons annually. <br /> <br />D. The City desires to modernize, reconstruct and improve the elevator <br />in order to bring the existing elevator up to current industry standards. The <br />existing equipment was installed in 1983 and the hall and car were <br />upgraded in 2002. The other major equipment is original and is beyond the <br />typical lifespan for this type of equipment. Further, the current elevator <br />does not stop level with the floor, which presents a safety hazard and does <br />not meet current ADA requirements. <br /> <br />E. The improvements to be made to the elevator at The Depot will be of <br />benefit to the merged Project Area (and the former Inter City Project Area) <br />as well as benefit the immediate neighborhood and all patrons of The <br />Depot. <br /> <br />F. The City lacks funds to pay for the reconstruction and installation of <br />the modernization improvements needed by The Depot elevator at this <br />time, and there are no other reasonable means of financing the <br />improvements. <br /> <br />G. Reconstruction of the elevator at a publicly owned transportation <br />facility will assist in the elimination of one or more blighting conditions in that <br />the new and improved elevator will replace the antiquated elevator that <br />constitutes a public safety hazard. Further, reconstruction of the elevator <br />will bring it into compliance with the ADA. <br /> <br />Section 2. In accordance with California Environmental Quality Act, the <br />proposed project is exempt from further review pursuant to section 15301 (d), which <br />allows the restoration of deteriorated or damaged mechanical equipment for the purpose <br />of meeting current standards for public health and safety. Categorical Exemption <br />Environmental Review No. 07-05 will be filed for this project. <br /> <br />Section 3. The City Council hereby consents to the payment by the Agency of <br />up to $88,427.00 in Agency funds from the Merged Project Area for this publicly owned <br />improvement, in accordance with that certain Cooperative Agreement to be executed <br />between the Agency and the City. <br /> <br />Section 4. The City Manager is hereby authorized to take all steps, and to sign <br />all documents and instruments necessary to implement and carry out the Resolution on <br />behalf of the City. <br /> <br />Section 5. The Clerk of the Council shall attest to and certify the vote adopting <br />this Resolution. <br /> <br />ADOPTED this <br /> <br />day of <br /> <br />,2007. <br /> <br />80C-6 <br /> <br />
