<br />City Council approve and adopt the amended Mitigated Negative <br />Declaration and Mitigation Monitoring Program, Environmental Review No. <br />2004-234. <br /> <br />D. The amended Mitigated Negative Declaration and Mitigation Monitoring <br />Program, Environmental Review No. 2004-234, Amendment Application <br />No. 2006-04, Conditional Use Permit No. 2006-14, and Site Plan Review <br />No. 2006-07 came before the City Council of the City of Santa Ana for a <br />public hearing February 5, 2007, and at that time considered all testimony, <br />written and oral. <br /> <br />E. Conditional Use Permit No. 2006-14 has been filed with the City of Santa <br />Ana seeking to allow a live-work community for the property located at 320 <br />West Fourth Street. <br /> <br />1. Santa Ana Municipal Code Section 41-638 authorizes the City <br />Council to grant a conditional use permit upon making certain <br />findings. <br /> <br />i. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />the community? <br /> <br />The proposed new building will contribute to the <br />general well being of the area by providing new <br />pedestrian friendly commercial space along the <br />predominantly commercial Fourth Street corridor on a <br />lot that has been vacant for a long period of time. <br />Further, the proposed residential land use in the upper <br />floors of the proposed building will only enhance the <br />vibrancy of the Downtown by bringing additional <br />consumers and entrepreneurs directly to the area. <br /> <br />ii. Will the proposed use under the circumstances of the <br />particular case be detrimental to the health, safety or general <br />welfare of persons residing or working in the vicinity? <br /> <br />The proposed residential land use in the upper floors <br />of the proposed building will not be detrimental to the <br />health, safety or general welfare of persons residing <br />or working in the vicinity. The parking garage is <br />secured via remote control access only to allow for <br />secure use of the parking area for residents. <br />Additionally, the alley will be well-lit to as to offer <br />increased safety and more visibility to drivers. The <br />parking area will also be enhanced through a mirror to <br />allow drivers backing into the alley to see oncoming <br /> <br />Resolution No. 2007- <br />Page2of11 <br /> <br />80A-123 <br />
